Local Laws & Regulations

Real Estate

Buying or selling a property in Ontario can be overwhelming, with various regulations and requirements to consider. I'm here to offer personalised guidance and support to make the process as smooth as possible. Real estate agents in Ontario must be licensed by the Real Estate Council of Ontario (RECO) and follow professional standards. Sellers must disclose material defects to buyers and buyers pay a land transfer tax based on purchase price. Also, properties in GTA & Mississauga are subject to zoning and building codes. Condos are governed by the Condominium Act and buyers should review the bylaws and financial statements included therein. Non-residents are subject to Non-Resident Speculation Tax (NRST) and need an Individual Tax Number (ITN).

Family Law

Going through a divorce can be a complex and emotionally difficult experience. It's important to have a trustworthy legal professional like myself to help with the legal proceedings. In Ontario, there are specific laws for married couples seeking a divorce. If a year of living apart has passed or grounds such as adultery or cruelty exist, a divorce can be obtained. The Family Law Act is the guiding principle for dividing property and assets, while the Children's Law Reform Act provides guidance on child custody, access, and support. Child support payments are calculated based on income and the number of children, as outlined in the Federal Child Support Guidelines. Spousal support may also be required and is determined by the Spousal Support Advisory Guidelines. Likewise, disputes can be resolved through mediation or collaborative law without going to court.

Business Law

Starting a business in Ontario requires choosing the right legal structure, such as a sole proprietorship, partnership, or corporation. If opting for a corporation, you'll need to comply with the Business Corporations Act. Contracts must be in writing and include clear terms and conditions. Employment contracts must follow the Employment Standards Act. Protect your intellectual property with guidance from Ontario's Intellectual Property Office. Finally, comply with various taxes, such as corporate income tax and sales tax, with guidance from the Canada Revenue Agency.

Wills, Trusts & Estates

In the province of Ontario, creating a valid will is subject to certain requirements. You must be at least 18 years old and of sound mind, and two witnesses must be present during the signing process. If you're looking for estate planning options, trusts can be a helpful tool to consider. They can also help you avoid probate fees. Additionally, it's important to be aware of the different types of powers of attorney that exist in Ontario. For example, there are powers of attorney for property and personal care. Estate administration is another important consideration. To ensure your wishes are carried out properly, you'll need to appoint an estate trustee. Finally, when planning for your estate, it's crucial to think about taxes and how you can minimise fees.

Notarization

Notarization is important for authenticating legal documents in the GTA or Mississauga. Notaries public verify the authenticity and witness signatures on documents like affidavits, powers of attorney, and travel consent letters. They require valid government-issued ID for identification and can charge fees determined by the Law Society of Ontario. Once notarized, documents receive a notarial certificate confirming their authenticity and the identity of the signer. Notarization is crucial for government agencies, financial institutions, and other organisations to recognize the validity of legal documents.

Need More Help?

As part of their job, lawyers offer guidance and advocacy to clients involved in criminal or civil cases, as well as other legal matters. They communicate with various parties related to a case, including clients, colleagues, and judges. Additionally, they conduct research and analyse legal issues to provide the best possible counsel.
A lawyer has many responsibilities, amongst:

Providing legal advice

One of my primary functions as a lawyer is to provide legal advice to clients, go through a process of analysis, research and offer guidance.

Representing clients in court

Lawyers who are an attorney and barrister like myself, are qualified to represent clients in court. We present arguments, cross examine witnesses and advocate on behalf of our clients.

Drafting legal documents

As a lawyer, I´m responsible for drafting legal documents and ensuring they reflect the intentions of the client and comply with laws and regulations.

Negotiating settlements

Lawyers engage in negotiations with opposing parties or their legal representatives to settle agreements outside of court.

Providing notary services

As a notary public, I can witness legal document signatures and certify their authenticity. I also notarize affidavits, declarations, powers of attorney, and travel consent letters.

When searching for a lawyer to hire, there are certain traits to look for to ensure they are a good fit for your legal needs. These include their knowledge and experience in the specific area of law related to your case, and their ability to communicate clearly and regularly update you on your case's progress.

It's crucial for your lawyer to be accessible and responsive to your questions and concerns while conducting themselves professionally and ethically. Cost transparency is also vital, and a good lawyer should explain all fees clearly and offer flexible payment options. Ultimately, the best lawyer for you is someone with the necessary skills and expertise to handle your case effectively while earning your trust and making you feel comfortable throughout the process.

I understand how important it is to provide exceptional legal services that genuinely advocate for my client's needs. That's why I prioritise communicating clearly, maintaining a professional demeanour, and being readily available. Building a solid relationship with my clients is critical, so I work hard to establish a foundation of trust and respect.

The difference between a lawyer and an attorney is that while these two terms may be used interchangeably, they refer to slightly different roles. A lawyer is an individual who has received legal education and is licensed to practice law. On the other hand, an attorney is a lawyer who has been granted the power to act on behalf of someone else in legal matters. Specifically, the attorney has the legal authority to represent clients and advocate for them in legal proceedings. Therefore, while all attorneys are lawyers, not all lawyers are attorneys.

Legal fees in Ontario and Canada in general can vary based on the experience and reputation of the lawyer hired. It can be overwhelming to navigate the cost of legal representation, especially when less experienced lawyers may charge between $200 and $500 per hour, and more established ones may charge up to $1500 per hour. Additionally, fees may also vary based on the type and complexity of the case. As someone who believes in the importance of accessible legal representation, I strive to offer affordable and reasonable fees for my services.

If you're feeling like the lawyer you hired isn't providing you with the necessary assistance, it's crucial to first assess the situation and figure out why. It could be a simple miscommunication that can be resolved through honest, open conversation. If your attempts to communicate with the lawyer have been unsuccessful or unsatisfactory, you may need to take further action.

This may involve reporting the lawyer to their state bar association or filing a complaint with the appropriate regulatory body. However, before doing so, make sure you're not breaking any rules or ethical obligations and that you're acting in your best interest. To me it's important to prioritise honest communication with my clients, as well as guide and support whenever possible. If a client feels they're not receiving adequate assistance, I will always listen to their concerns and collaborate to find a solution that meets their needs.

Lawyers provide legal services and guidance to individuals, organisations, and businesses. I am trained to understand and apply the law to various situations and can assist my clients in navigating complex legal issues. Also, I am responsible for promoting access to justice and upholding the rule of law.

I also have a responsibility to uphold ethical standards and promote the administration of justice. This can involve acting as a mediator or arbitrator to help resolve disputes outside of court and representing clients in court proceedings when necessary.

As a legal professional, it is my job to ensure that individuals and organisations in my community have access to legal representation and guidance and to work to promote social justice and uphold the rule of law.
